WASHINGTON COURT HOUSE, Ohio — The Fayette County Board of Commissioners will take up outside counsel for changes to the county’s development agreement with Amazon Web Services when it meets Monday, according to the board’s published agenda.

The agenda for the Nov. 2 regular meeting lists, under new business, engaging the law firm Bricker Graydon Wyatt LLP “in modifying the development agreement with AWS.” The agenda does not say what changes are contemplated. AWS has said it plans to invest $5 billion by 2030 in a data center campus in Fayette County near Interstate 71 and U.S. Route 35, in the Jeffersonville area, near the Honda and LG Energy Solution battery plant. The commissioners previously approved a community reinvestment area agreement for the project.

The board’s AWS item comes six weeks after commissioners voted Sept. 21 to impose a one-year moratorium on new data center development in seven Fayette County townships — Concord, Green, Jasper, Madison, Marion, Paint and Perry — while the county finishes an update of its comprehensive land use plan. Projects already authorized are exempt from the freeze.

Also on Monday’s agenda is a 10:30 a.m. bid opening for Fayette County Transfer Station waste hauling and disposal, and a vote on whether to raise the Planning Commission board member rate from $12 to $25 per meeting.
